Hosting Terms & Conditions


Summary

  • All payments for hosting services must be paid in advance. Non-payment may result in your account being suspended or cancelled
  • Any content, or links to content which in our view is illegal, offensive or risks damage to our systems or clients will be removed and may result in cancellation of your account.
  • Our services are provided on an "as is" and "as available" basis. Your use of the service is at your sole risk - Tweezy is not responsible for files and data residing on your account.
  • By placing and/or maintaining material on Tweezy's servers, you acknowledge that you have read, understood and accepted the terms and conditions.


Accounts

Before creating a hosting account, we require a current and truthful name, postal address and telephone number for our records. You have a continuing obligation to notify us of any changes to these details by email to accounts@tweezy.com.au.

We reserve the right to refuse, cancel, or suspend service at our sole discretion. Accounts will not be created in the name of anyone under 18 years of age.

Payments

New accounts are payable in full at the time the account is created. This includes any setup fees, and fees for the initial period of hosting. You can choose to pay for hosting services quarterly, 6-monthly or annually. All payments for hosting services must be paid in advance.

Tweezy will send you a Tax Invoice showing the amount payable and the due date. Such invoices will be sent to your postal address (as advised by you), and a reminder may (but might not) be sent to your email address. It is your responsibility to advise Tweezy if and when these addresses are changed.

If any payment is not received promptly by the due date, we reserve the right to suspend your account after a short period of grace.

Termination / suspension

You may cancel your account at any time. If cancellation is made within the first 30 days of service all hosting fees will be refunded. However account setup fees and any excess disk space and data traffic charges are non-refundable.

If you do something that results in a suspension or deactivation of your account, all fees paid will be forfeited. In addition, you will be liable for the cost of rectifying any damage that has been caused by your actions.

If your account is suspended for non-payment, it will not be restored until we receive payment of all arrears, plus an administrative fee of $33.00 (including GST).

Acceptable use

You may occupy only the amount of disk space on the Tweezy Hosting server and utilise no more than the network data transfer as is allocated to you by Tweezy Hosting. Additional fees will be charged for exceeding your disk space and/or network traffic allowance.

All services provided by Tweezy may be used for lawful purposes only. Transmission, storage or presentation of, or links to, any information, data or material in violation of any state, federal or foreign law is prohibited. This includes, but is not limited to:
  • copyrighted material
  • material protected by trade secret or other statute
  • material which constitutes invasion of privacy
  • pornography or sex-related merchandising
  • pirated software or warez
  • hacker programs/archives
  • material which promotes any illegal activity or presents content that may be damaging to any server on the internet
Any attempt to cause harm to a server or customer of Tweezy will be grounds for immediate account cancellation. This includes, but is not limited to:
  • using programs that consume excessive CPU time
  • allowing the use of unapproved mail services, mail forwarding capabilities or auto-responders
  • resale of disk space
  • unauthorised CGI or PHP shell scripts
  • use of any servers, bots, bouncers, or any other software that is used for the purpose of creating, maintaining, or providing access to IRC servers or channels.
  • sending unsolicited email (commonly known as spam)
  • Web Proxy scripts are not permitted, and will be deleted when discovered
Tweezy will be the sole arbiter in determining violations of this provision.

You agree that Tweezy has the right to monitor the data passing through our systems from time to time and to disclose any information as necessary to satisfy the law, or to protect itself or its customers.

General information

Tweezy may provide third party programs or scripts for your use (eg shopping carts, email, statistics, etc) as part of your hosting package. Please note that Tweezy does not provide support services for these programs - information about, or support for these programs should be obtained from their developers.

Our services are provided on an "as is" and "as available" basis. Apart from the 30-day money back guarantee, Tweezy makes no warranties or representations of any kind for the services being offered.

Tweezy performs daily backups on all servers which can be restored in the case of a system failure; however, it is your responsibility to keep your own copy of any web pages and other data stored on Tweezy's servers.

We make every effort to have our servers operational at all times, however due to the nature of internet connections your web site and email may not be available from time to time, even though our systems are operating perfectly.

The laws of the State of Tasmania, Australia govern the operations of Tweezy, and any claims are subject to the laws of that state.

Acknowledgement

This agreement supersedes any written, electronic, or oral communication you may have had with Tweezy or any agent or representative thereof, and constitutes the complete and total agreement between the parties.

You agree to indemnify, defend, and hold Tweezy harmless against any and all liability, penalties, losses, damages, costs, expenses, legal fees, causes of action or claims resulting directly or indirectly from your use of the service, which damages yourself or any other party or parties, without limitation or exception. This extends to all issues associated with your account, including but not limited to domain name selection and web site content.

In the event that any provision of this agreement is determined to be invalid or unenforceable, all other provisions shall remain in full force and effect and said provision shall be reformed only to the extent necessary to make it enforceable.

By placing and/or maintaining material on Tweezy's servers, either personally or by any third party on your behalf, you are acknowledging that you have read and understood these terms and conditions, and agree to be bound by them.

These Terms and Conditions are subject to change without notice. Continued usage of the services after such a change is implemented and posted on the Tweezy web site constitutes your acceptance of such change. We encourage you to regularly check the Tweezy web site for any changes or additions to these Terms and Conditions.
